When Samuel and Frances Sold the 1st land grant to John Anderson:

South Carolina viz.
This indenture made the 16th day of November in the 24th Year of the
Reign of our Sovereign Lord George the Second by the Grace of God of Great
Britain France & Ireland King Defender of the faith &c. Anno Dom # 1750
between Samuel Lynes of Craven County in the Province afores. Planter and
Frances his wife of the one part & John Anderson of the said County &
Province Weaver of the other part WITNESSETH That for & in Consideration of
the Sum of One Hundred Pounds lawful moneys of the Province afore said from
the said John Anderson to the said Samuel Lynes and Frances his wife at or
before the Sealing & Delivery of these Presents in hand well & truly paid the
full Receipt where of they the said Samuel Lynes and Frances his Wife do hereby
acknowledge & there of & of every part & parcel thereof do fully & Absolutely
acquit release & discharge the said John Anderson his heirs Exors & Adores
forever by these Presents they the said Samuel Lynes & Frances his wife have
bargained Sold Aliened granted and Released & confirm & by these presents do
fully and absolutely bargain Sell alien grant Release & Confirm unto the said
John Anderson in his actual Possession now being by Virtue of a bargain &
Sale to him thereof made by the said Samuel Lynes for one whole year. By
indenture of lease bearing date the day next before the day of the Date of
presents Sealed and delivered before the sealing & delivery of these presence of
Tract of land Virtue of the Statute for transferring uses into possession and to his
heir and assigns all that Purcell or Tract of land containing two hundred acres
Situate lying and being the province aforesaid near the Congrees North side
Santee River & butting & bounding the Northward part on land laid out Richard
Jackson now belonging to Henry Snelling and part on land laid out Elizabeth
Verdetty to the Westward part on land laid out to Elizabeth Verdetty and part on
a tact of fifty acres of land with which the said Tract of two hundred acres was
originally granted & hath such shape from & mark as are respectively represented
in a Plat to the Original Grant annexed, together all woods under woods Timber
& Timer trees lake Ponds waters water courses pasture feeding houses building
Gardens Orchard profits Commodities Appurtenances & H predicaments what so
ever There to belonging or in any wise appertaining and the Reversion and
reversions & remainders rents issues and profit there of also all the Rights Estate
Title Interest Property Claim and demand what so ever. He the said Samuel
Lynes and she his her or their heirs hereafter ought might or could in, to or out
the said Two hundred acres of land and all and singular other the premises with
their every of their appurtenances both in Law and equity together with the
original Grant To Have & To Hold the said Two Hundred acres of land and all
and singular other the premises herein before mentioned or meant and intended to
be hereby granted & Released with their and every of their appurtenances unto
him the said John Anderson his heirs and assigns for ever to the sole use of him
the said John Anderson his heir or assigns for evermore and the said Samuel
Lynes and Frances his wife for themselves and their heirs the said Premises hereby
granted and released or meant & intended to be hereby granted & released with
their & apportions unto him the said John Anderson to his heirs & Assigns
against all manner of person or persons whatsoever shall & will warrant &
forever defend by these presents and the said Samuel Lynes & Frances his wife
for themselves their heirs Exors & admors do covenant promise and grant to &
with the said John Anderson his heirs & assigns in manner & form following
that is to say that he the Samuel Lynes now at the time of the Sealing &
delivery of these presents and standeth Lawfully & absolutely sezed in & of the
said two hundred acres all & singular other the premises herein before mentioned
& meant & intended to be hereby granted & released with their & every of their
appurtees of a good sure perfect & absolute Estate of inheritance in fee simple
without any manner of Condition Limitation matter or thing whatsoever to alter
defeat or determine the same, and also that the said Samuel Lynes now hath in
himself good right full power and lawfull authority to grant release & confirm
the said two hundred acres of land & all & singular other the premises hereby
granted & released with their & every of their appurtees unto him the said John
Anderson his heirs & Assigns for ever in manner aforesaid and also that for &
notwithstanding any Act matter or thing whatsoever had made done committed or
suffered or to be had made done committed or suffered to the contrary by the said
Samuel Lynes or Frances his wife or his her or their heirs or assigns it shall &
may be Lawfull to and for the said John Anderson his heirs & assigns from time
to time & at all times hereafter peaceably and quietly to enter into have hold use
occupy posses & enjoy the said two hundred acres of land & all & singular
other the premises herein before mentioned and meant or intended to be hereby
granted & released and every part & parcel thereof with their & every of their
appurtees without any the let Suit Trouble hindrance molestation or interruption
whatsoever of him the said Samuel Lynes or Frances his wife or his her or their
heirs or Executors & ad more or any person or whatsoever lawfull claiming or to
claim by from or under him her them or any of them and that free and clear and
clear and free and clearly acquitted and discharged or kept free & clear of all
demands and in cumbrances whatsoever the quit rent thereon reserved to his
Majesty his heirs and successors and others the provisos mentioned in the
Original grant only except, in witness wherefore the said parties to these presents
have hereunto interchangeably set their hands and seals the day & year first above

A note from Barry A. Hough on 5/8/2013 1900 Foxbank The Frances Dangerfield age 14 listed as friend is a daughter of Joe "Buck" Dangerfield, Joe was a son of Starling James Dangerfield who died at Petersburg VA 1864 serving in the 11th Reg. Co. C with a lot of my family. son Joe also was killed in early 1900s, he was a night policeman in the train yards and was murdered by some who didn't like him. This Frances just a month ago I looked up, she had married an Italian man named Ruda in Charleston and later moved to Brooklyn NY where both are buried. the funny thing is as a child I was born and raised in Brooklyn and played with her grandson Joey Ruda and never knew that we shared family roots together until last month some 50 yrs later. |
